Less Restrictive Law Regarding Dogs On Beaches Up For Hearing

Southold Town Board decides on January public hearing on amended code regarding dog access to town beaches.

Local dogs — and dog owners — will soon have their day, legally, on Southold Town beaches.

Months after a Mattituck resident complained to the Southold Town Board that he was attacked by two dogs running loose on Bailie Beach in Mattituck this past summer and requested that the board create a town-wide rule that all dogs must be kept on leashes at beaches, board members will present an updated version of an antiquated town law regarding the issue for public hearing later this month.

The board voted during a meeting Wednesday night to set the public hearing for Jan. 15 on amendments to Chapter 193 of town code, which Southold Town Supervisor Scott Russell said last summer was written in 1981 and did not allow dogs on beaches or any recreational area at all.

“But I think this is too restrictive and we need to balance this out to accommodate all sides,” he said at the time.

The proposed local law reads as follows:

A Local Law entitled, “A Local Law in relation to Amendments to Chapter 193, Parks and Recreation Areas, in connection with Dogs or Domestic Animals on Town Recreational Areas”.

BE IT ENACTED by the Town Board of the Town of Southold as follows:

I.              Purpose.

              The purpose of these Amendments is to protect the health, safety and wellbeing of residents using Town recreational areas by enacting regulations pertaining to dogs and other domestic animals on Town-owned recreational areas, bathing beaches, children’s play areas, picnic areas and athletic fields.  

II.              Chapter 193 of the Code of the Town of Southold is hereby amended as follows:

§193-3.1.  Regulations concerning dogs or domestic animals.   

A.              Prohibition.  No person shall bring a dog or other domestic animal onto:

1.              recreation areas, picnic areas, children’s play areas and/or athletic fields that are posted with signage indicating “No Dogs or Domestic Animals Allowed” or “Dogs or Domestic Animals Prohibited”;

2.              bathing beaches during such times that a lifeguard is on duty;

3.              an area that is within 50 feet of any recreation area that is posted for protection of piping plovers and other endangered species.

B.              Dogs or other domestic animals are permitted on all other recreational areas unless specifically prohibited in §193-3.1(A), subject to the following:

1.              All dogs or domestic animals shall be under immediate supervision and control of the owner or other responsible person (the owner or responsible person has the ability to leash the dog or other animal immediately). 

2.              All dogs or domestic animals brought onto children’s play areas, picnic areas or athletic fields shall be leashed at all times.

C.              All dog or domestic animal waste shall be removed in accordance with §83-18(B). 

D.              The Superintendent may, in his or her discretion, promulgate additional rules and regulations as necessary.

Peconic resident Robert Dunn was only speaker at Wednesday night’s meeting on the issue and suggested that the board hold off on a public hearing until more part-time summer residents could weigh in at Town Hall.

“Mr. Dunn’s point is well-taken, but we can hold the hearing open and hold a second round,” said Councilman William Ruland. “But we want the culmination of feedback by the early spring before the next sunbathing season.”

To The Town of Southold:
Please post NO DOGS PERMITTED sign on the East Marion Schoolhouse Park tennis court (and all Town courts). For some reason some dog owners feel that using the court as a daily dog run is an appropriate use. It is not. These outings often leaving behind evidence aside from damaging the surface.

I think it is a good idea but I would like to hear more about the pros and cons. I am a dog owner and believe that dogs should be able to run on the beach as long as they do not pose a threat to others, particularly children, and people clean up after their pets. Since this is primarily an issue that affects summer enjoyment at the beach, I think summer residents/property owners should have more notice and time to weigh in.

with all the beaches we have in this town, we could certainly dedicate a section of one -- in each hamlet -- to man's best friend. and re: the dog park. i have seen a dog park where my daughter lives, that has a man made lake as part of the park for water loving dogs.

Over 36 years years of work- I earned my pension and the free time it allots me. I have also volunteered quite a bit over the years for several organizations.

bailie beach is a problem. i've been repeatedly harassed by dogs running loose there, with owners indifferent and sometimes hostile.

I see more dog owners allowing their dogs to use the beach like a litter box. The owner walks over and just buries the mess with sand like nothing happened. It is impossible to police proper behavior of dog owners. Now some dogs are just wonderful as are their owners, other dogs can be more aggressive breeds which by nature are protective of their owner at the peril of another person using the beach. You have some well trained dogs and others who have never been trained. Your only option is to pass a law to ban dogs which is too bad.

I spend a good amount of time at Bailie Beach, and have never seen dogs "harrassing" anyone, and think this is a great place for folks to take their non-aggressive dogs to play, socialize and exercise.. But, I do believe there should be stiff penalties for not picking up dog waste.

I must reluctantly agree. Some dog owners are responsible & pick up after their dogs, but, in New Suffolk, we've seen the evidence first-hand. Many of us in NS have frequently cleaned up after dogs that are not our own at the Town beach.

Of ALL people who should grasp the concept of plagiarism and copyright laws, it should be a newspaper editor/publisher! Cropping out her signature proves they knew full well that they were stealing her work. I'd suggest the artist contact a copyright attorney pronto. I'm always astonished when something like this occurs when a simple phone call to the artist might have been successful in allowing him to use her work WITH her signature intact instead of doing something so underhanded.

I've just tried to do a Google search for you and from what I've found you need to either check withRead More your local library to see if they have one they might lend you--OR--try Audio/Visual online companies. There are some which DO rent projectors for days or weekends. I have one but just checked with my husband and at the very least it needs a replacement bulb(which are fairly expensive)--hasn't been looked at in years so there's no way I could guarantee it would work. You've definitely given me an idea, though--I'll get mine in shape at some point and rent it to folks for a nominal sum. I'm sure there are many others who have old film they'd enjoy viewing for family reunions as would my own family. Good luck. If you don't succeed for next weekend, you have other options. At the very least you might be able to have the film transposed to a DVD and distributed to your family members although that's costly too, depending on how many copies you need. Just a thought, but you could add the old footage in with some taken AT the reunion as a nice follow-up gift for the attendees?
