Hess Lawsuit Against Town is Dropped

Mattituck Hess gas station owners were suing Southold Town for a permit to build a 24-hour convenience store , but the lawsuit has been dropped, according to the Suffolk Times.

Facing virtually no support from the Mattituck community, the owners of the Mattituck have given up the fight to get a 24-hour convenience store built at their property on the corner of Route 25 and Bay Avenue, according to the

Hess applied for a change of zoning in 2003 in order to build a 1,660-square-foot store. But Southold Town has no legal obligation to entertain zone change applications, and a recently passed law limits gas station convenience stores to 800-square-feet.

The Hess case has been removed from the state Supreme Court calendar, according to the report.

The news comes in the midst of another legal tangle between the town and a Mattituck business — a certificate of occupancy for the newly built 7-Eleven is being between the business owner and the Department of Transportation over the removal of a utility pole on the property at the corner of Route 25 and Factory Avenue.
