Cops: Mom Drove Drunk, Off Road, With Baby in Car

The mother was charged with a felony for violating Leandra's Law, police said.

A Mattituck woman was charged with driving while intoxicated with her 17-month-old baby, in the car in Jamesport early Tuesday morning.

According to Riverhead Town police, Lindsay Marino, 22, was involved in a single-car accident at 1:27 a.m. on Main Road.

Police said upon arrival at the scene, Marino was out of the vehicle with her baby; the car was located off the road.

Emergency medical services were dispatched to the scene; neither mother nor infant was injured, police said.

Upon investigation, police said Marino was charged with driving while intoxicated, a felony, and charged with violating Leandra's Law, for operating a motor vehicle while intoxicated with a child under the age of 15. She was also charged with endangering the welfare of a child, a misdemeanor.

Both mother and child were taken to Peconic Bay Medical Center "as a precaution measure," police said; both were released and Marino was transported to Riverhead police headquarters, processed, and held for morning arraignment.

The baby was released to its grandfather, police said.
